1. EXCLUSION OF LIABILITY

  • All persons entering or making use of a vehicle or property belonging to Padlangs will do so entirely and solely at their own risk.
  • Padlangs will not be held liable for loss or damage suffered (including consequential or special damages or loss of profit), loss of life, bodily injury or loss of property in whatsoever nature whether it being caused or not caused by Padlangs, it’s directors, officers, agents, staff or any other person acting on behalf and under the authority of Padlangs of which damage or loss of whatsoever kind arising out of or connected to the transportation or non-transportation by Padlangs of any passenger, person or their property.

2. TICKETS

  • Tickets can ONLY be purchased on www.padlangs.tours or by contacting Padlangs directly on info@padlangs.tours or 063 733 2370. We are currently not making use of any 3rd party vendors, hence, tickets purchased otherwise (including through ticket reselling) will be void/invalid and there will be no claim against Padlangs or any person associated to Padlangs for any loss suffered.
  • Passengers are not allowed to resell or promote their tickets, if one fails to do so Padlangs reserves the right to take legal steps.
  • The proof of payment must be provided within 3 hours of making the booking. Should you fail to do so, the ticket/seat will be forfeited.
  • Passengers must provide their full names when booking a ticket. Tickets are only valid to the person, date and time reflected on the ticket. Proof of identification must be shown when boarding the vehicle. Additional documentation may be requested in the case of a minor child.
  • It is the passenger’s responsibility to ensure that all details reflected on the ticket are correct.
  • Passengers will not be permitted to break up their trip into multiple legs unless tickets are purchased for every leg.
  • Tickets are non-transferable in peak times (November-January). Tickets may be postponed to a further date, please refer to our cancellation policy and detail changes.
  • The ticket serves a proof of transport agreement between Padlangs and the purchaser and the passenger along with the Terms and Conditions will constitute the entire agreement.

3. CANCELLATION POLICY

Tickets may be cancelled and a refund or credit note will be issued subject to the following:

Peak times: November – January :

  • More than 8 weeks before departure, a full refund will be made to the purchaser, of which an administrative fee of R200.00 per ticket will be charged.
  • More than 4 weeks before departure, a credit note will be issued OR the purchaser will only receive a 50% ticket fare refund, of which an administrative fee of R200.00 per ticket will be charged.
  • Less than 4 weeks before departure NO refunds or credit notes will be issued.Tickets will be automatically cancelled and no refund made for no- shows.
  • Any change to a ticket must be made at least 4 days prior to departure of which an administrative fee will be charged, otherwise the ticket will be forfeited and no refund will be made. (No name changes during peak season.)

February – October :

  • More than 4 weeks before departure, a full refund will be made to the purchaser, of which an administrative fee of R200.00 per ticket will be charged.
  • More than 10 days before departure, a credit note will be issued OR the purchaser will only receive a 50% ticket fare refund, of which an administrative fee of R200.00 per ticket will be charged.
  • More than 7 days before departure, a credit note will be issued, no cash refunds.Tickets will be automatically cancelled and no refund made for no- shows.
  • Any change to a ticket must be made at least 4 days prior to departure otherwise the ticket will be forfeited and no refund will be made.

Detail change in tickets:

  • Any changes made to an existing ticket will result in the issuing of a new ticket of which an administrative fee of R200.00 will be charged. The changes include the date and time of the ticket.
  • Name changes can only be made from February-October of which an administrative fee of R250,00 will be charged. 
  • Where changes have been made, Padlangs cannot guarantee the same fare and or discount received on the current ticket.
  • In the event of death or hospitalisation of the passenger himself a full refund will be made to the purchaser upon receipt of a documentary proof thereof.
  • Any change to a ticket must be made at least 4 days prior to departure otherwise the ticket will be forfeited and no refund will be made. 
  • Padlangs reserves the right to cancel a service without prior notice and will not be held liable for any loss or damage.

4. DEPARTURE TIMES

  • All departure and arrival times and places will be communicated with the passengers within a reasonable time before departure.
  • Passengers must arrive 20 minutes before their departure time to allow the bus to leave as per applicable schedule.
  • We will make all efforts to keep to the schedule timetable, however, no guarantee is made with respect to departure and arrival times. Padlangs will in the event of a deviation from the schedule, not be held liable for any damage, loss or inconvenience.
  • We will make reasonable efforts to ensure timely connection with other transport operators.
  • Should any seat not be filled within 10 minutes of departure the ticket will be forfeited and no refund will be made.

5. BAGGAGE

  • Each passenger is permitted to take, free of charge and at own risk, 2 pieces of luggage not exceeding 80cm X 60cm X 30xm or a total mass 30kg of the luggage together. (30kg max per person)
  • Should the luggage not meet the parameters, prior arrangement must be made at least 3 days before departure and Padlangs reserves the right to charge an extra fee. Should no prior arrangement be made, the luggage will not be loaded on the vehicle.
  • No unaccompanied luggage will be transported. Padlangs reserves the right and at its own discretion to refuse the carriage of any luggage, goods or person.
  • Padlangs does not provide insurance cover for passengers, their property or luggage. It remains the passenger’s responsibility to ensure they are property insured.
  • Padlangs will make all efforts to prevent loss, damage, injury or death but will not be held liable for said whatever manner from the transport or non- transport of any person, goods or property resulting in loss, damage to passenger’s, hand luggage, personal effects, personal safety, bodily injury,death, loss of income or profit
  • Passenger accepting a ticket indemnifies Padlangs to the fullest extent permissible by law against a claim arising either directly, indirectly or consequential damage whether result is immediate, future loss or damage, death or bodily injury arising at common law, statutory law, customary law and indigenous law.
  • In the event that Padlangs is held liable for any loss, damage, death or injury by a court with competent jurisdiction, the claim will be limited to R5000.00.
  • All luggage must be loaded only by Padlangs staff members.
  • Please refer to Appendix A for the list of items that will not be transported by Padlangs.

6. CHILDREN

  • Children under the age of 9 will not be permitted to travel unaccompanied.
    • Children between the ages of 10 and 18 may travel unaccompanied upon a parent agreeing to Padlangs (Pty) Ltd Terms & Conditions. By signing the Terms & Conditions the parent / guardian of the child herewith fully indemnifies Padlangs Tours (Pty) Ltd as set out and more fully described in Appendix B.
  • Padlangs is unfortunately not able to accommodate children under 3 years of age and will, hence, not be permitted to travel.
  • Padlangs will not be held liable to any cause arising from the refusal to travel.
  • We are fully committed to preventing human trafficking and will entirely collaborate and cooperate with law enforcement.

7. PREGNANT PASSENGERS

  • Pregnant persons that are 30 weeks pregnant will not be permitted to travel.
  • Passengers that are 28 weeks pregnant will be permitted to travel upon providing a letter from your doctor, stating you are fit to travel.
  • By signing the Terms and Conditions, a pregnant passenger herewith fully indemnifies Padlangs (Pty) Ltd as set out and more fully described in Appendix C.
  • The expectant mother is solely responsible for providing the contact information of her next of kin or doctor, should the need arise to contact either.

8. SMOKING, ALCOHOL AND PETS

  • The smoking of tobacco or electronic devices/vapes is prohibited.
  • The consumption of alcohol or any other substance on board the vehicle is prohibited. We reserve the right to refuse carriage of any intoxicated persons.
  • Pets are prohibited, unless it’s a trained dog accompanied by a blind person.

9. ON-BOARD ENTERTAINMENT

  • The on-board entertainment will be family friendly material and promoting the Christian faith.

10.SOCIAL MEDIA / WEBSITE AND / OR PUBLICATIONS FOR ADVERTISEMENT PURPOSES

  • Passengers, by signing the terms and conditions, hereby consent and grant Padlangs Tours (Pty) Ltd the right to publish, distribute or otherwise use photographs / videos taken of the passengers.
  • Padlangs Tours (Pty) Ltd will not be liable for any claims, demands or damage suffered in connection with the photographs / videos.
  • Passengers also waive their right to any compensation / royalties arising from the use of the photographs / videos.
  • Passengers acknowledge that the photographs / videos will be used in print publication, online publication, websites and social media for the sole purpose of advertising.

11. GENERAL

  • Padlangs has the right to inspect a ticket, travel documents, luggage, goods or packages of any passenger.
  • Right of refusal to transport or continued transport of any person, goods or luggage as far as it does not constitute unfair discrimination.
  • Seats are filled using the unique seat number on each passenger’s ticket. Prior arrangements should be made for handicapped persons.
  • It is compulsory to wear a seat belt at all times.
  • Should a passenger suffer from a medical condition, please consult a doctor before traveling and provide a letter from your doctor stating you are fit to travel.
  • Any complaints must be lodged within 7 days of your travel, otherwise it will not be considered. Please email complaints to info@padlangs.tours.
  • The terms and conditions set our severable from each other and the invalidity of any part does not affect the to the parts.

  • Only food items allowed for consumption on bus.

Padlangs will fully cooperate with law enforcement where necessary.

 

APPENDIX B: INDEMNITY FORM FOR UNACCOMPANIED MINORS

I, parent / guardian of the child travelling with Padlangs Tours (pty) Ltd

Hereby consent to my minor child making use of the transport services of Padlangs Tours(Pty) Ltd as per the Terms and Conditions.

I further confirm that the minor child is in good health and that any medical condition / allergies have been disclosed in writing to Padlangs Tours. Should any medical condition / allergy arise in the future, it is the sole responsibility of the parent / guardian to immediately inform Padlangs Tours in writing.

I acknowledge that in certain circumstances there may be insufficient time to contact me, or refer to medical records, and consequently Padlangs Tours, its drivers, employees, agents and / or partners are hereby authorized in my place and stead, to authorize and / or administer the most appropriate medical services available in the circumstances.

I confirm that the use of Padlangs Tour’s services is entirely voluntary and I accept all risk associated thereto. The drivers, employees, agents and / or partners shall not be held liable for any loss, damage, injury / death or illness (including consequential loss or damage) in whatsoever nature and however caused as a result of the direct or indirect use of Padlangs Tour’s services

I hereby indemnify Padlangs Tours and its drivers, employees, agents and / or partners for any direct or indirect loss, damage, injury of death suffered by me or the aforesaid child as per consequence of the use of Padlangs Tours services.

Furthermore, I confirm that I have read and accept the Terms and Conditions on behalf of myself and the minor child and consider myself bound thereto.

 

APPENDIX C: INDEMNITY FORM FOR PREGNANT PASSENGERS

I, the undersigned, confirm that at the date of signing this form the age of my pregnancy was as stated above and does not exceed 28 weeks. I further confirm that I have a healthy pregnancy and there are no abnormalities regarding the pregnancy. I fully take responsibility for any direct / indirect misrepresentation.

I hereby indemnify Padlangs Tours (Pty) Ltd, its directors, staff members or any agent from liability as a result of from injury, aggravation or deterioration in health of myself or unborn child.

I understand and acknowledge that:

  • As per paragraph 7 of the above terms and conditions, where a pregnancy is 30 week or more, such pregnant person will not be permitted to travel.
  • Where a pregnancy is 28 weeks, such passenger will be required to produce a letter from the doctor confirming the passenger is fit to travel.
  • Padlangs Tours (Pty) Ltd, its directors, staff members or agents reserve the right to refuse the boarding of a pregnant person should such person not meet the aforesaid requirements upon date of travel.
  • I understand that Padlangs Tours (Pty) Ltd cannot provide medically trained staff for the duration of the travel should any risks arise with myself or unborn child.

I confirm that I have read and accept the Terms and Conditions and consider myself bound thereto.
